Agreeing to these terms

These terms apply when you use the Creekstone Hayward Concrete Company website, starting from our home page, and when you hire us for concrete work. By using the site, asking for an estimate or accepting one, you agree to them.

If you don't agree with something here, please don't use the site, and call us before you book work so we can talk it through.

What we do

We're a concrete contractor in Hayward, CA. We build driveways, patios, sidewalks, steps, garage floors, retaining walls, foundations and related concrete work for homes and businesses in Hayward and the cities around it. You can read more about our crew on our About page.

What you read on this site is general information about the trade. It isn't a promise that a particular service fits your property, because we can only say that once we've seen the job in person.

Estimates and pricing

Our estimates are free, done in person and obligation-free. An estimate is based on what we can see and measure on the day, along with the size of the job, the materials you choose, how easy it is to get our equipment in and current material costs.

Some conditions only show up once the old concrete is broken out, such as soft or wet subgrade, which is the soil the slab sits on, tree roots or buried pipes. If we find something that changes the work or the price, we stop, show you, and get your approval in writing before we do anything extra.

An estimate holds for the time written on it. After that we may need to update it, because material and hauling costs change.

Your written agreement comes first

Before we start, you and Creekstone Hayward Concrete Company sign a written agreement that sets out the scope, price, payment schedule and timing for your job. If anything in that agreement differs from these terms, the signed agreement controls.

Scheduling, weather and cancellation

We give you a start date when you sign, and we'll keep you posted if it moves. Rain, extreme heat and other weather can change when we pour, because concrete placed in bad conditions comes out weaker. Moving a pour to protect your slab isn't a breach of our agreement.

We ask you to keep the work area clear, give our crew access, and tell us about sprinkler lines, buried cables or anything else private under the ground that we wouldn't know about. Once the concrete is down, you need to keep people, pets and cars off it for the curing time we give you, which is the wait while the concrete hardens and gains its strength.

If you need to cancel or reschedule, tell us as soon as you can. If you cancel after we've ordered materials or started work, you'll owe for the materials and the work done up to that point, as your written agreement describes.

Payment

Payments are due on the schedule in your written agreement, and the final payment is due when the work it covers is complete. We'll only ask for what that agreement allows.

If a payment isn't made when it's due, we may pause the work until it's settled and collect what's owed in any way the law allows.

Our guarantee and what to expect from concrete

Our work is backed by our satisfaction guarantee. If something about our work isn't right, call us, and we'll come out, look at it with you and fix what's ours to fix, as your written agreement describes.

Concrete is a natural material, and some things are normal rather than defects. Small hairline cracks can show up as a slab shrinks while it cures, which is why we cut control joints, the straight grooves that give the slab a planned place to crack. Color and texture can also vary from one pour to the next and from any sample you saw.

Our guarantee doesn't cover damage from ground movement or settling we couldn't have known about, tree roots, loads heavier than the slab was built for, harsh chemicals, use before the curing time is up, or changes made by someone else. Apart from our guarantee and anything else written in your agreement, the site and its content are provided as they are, without other promises.

Limits on our liability

To the extent the law allows, Creekstone Hayward Concrete Company isn't responsible for indirect or follow-on losses, such as lost use of a space or lost income, that come from the work or from using this site. Our total responsibility for any job is limited to the amount you paid us for that job.

Nothing in these terms takes away a right you have under California law that can't legally be waived.

Using this website

The words, photos and design on this site belong to us, and you may not copy them for commercial use without our permission. Links to other websites are there for your convenience, and we aren't responsible for what those sites say or do.

Please don't use the site or its contact form to send anything unlawful, harmful or misleading.

If we disagree

If you're unhappy with anything, call us first at (510) 264-7080. Most problems get sorted out quickly once we're both standing at the job and looking at the same thing.

If talking it through doesn't settle it, either of us may take the matter to a court with authority over it in Alameda County, California, including small claims court where the amount allows.

Which law applies

These terms, and any work we do for you, are governed by the laws of the State of California.

Changes to these terms

We may update these terms from time to time, and the version posted on this page is the current one. The terms in place when you sign your written agreement are the ones that apply to that job.
